Terms of Use for Kontrastfest.pl

These Terms and Conditions set forth the terms for the provision of electronic services by the Kontrastfest.pl platform, available at kontrastfest.pl, the rights and obligations of Users and the Service Provider, as well as the rules for participating in miniature painting contests organized through the Platform.

These Terms and Conditions have been drafted in accordance with the requirements of the Act of July 18, 2002, on the Provision of Electronic Services, and the Act of May 30, 2014, on Consumer Rights.

1. Definitions

The terms used in these Terms and Conditions have the following meanings:

  • Service Provider — the entity operating the Kontrastfest Platform, available at kontrastfest.pl, which can be contacted via email at kontakt@kontrastfest.pl.

  • Platform / Website — the Kontrastfest website, which facilitates the organization of the Kontrast competition and provides information about it.

  • User — a natural person with full legal capacity who uses the knowledge base related to the Kontrast competition.

  • Organizer — the entity responsible for organizing the Kontrast Contest.

  • Judge — A user designated by the Organizer to evaluate Entries in a given competition category.

  • Contest — the Kontrast International Figurine Painting Festival Kontrast other events organized through the Platform, in which figurines submitted by Users are judged.

  • Submission — a model of a figurine, along with a photo and description, sent by the User for a specific Contest.

  • Terms and Conditions — this document.

2. Type and Scope of Services

The service provider offers the following services electronically:

  • Sharing information about the competition to enable participation and provide insight into the format and content of the festival

  • Enabling registration for the Contest and the submission of entries by redirecting users to the external Kontrastreg platform.

  • Presenting the contest schedule, results, and awards.

3. Technical Requirements

To use the Platform properly, you must:

  • Having a device with Internet access.

  • The latest version of a web browser with JavaScript and cookies enabled.

  • An active email account.

  • Minimum screen resolution: 320 px (the interface is responsive).

4. Terms of Use for the Platform

The user agrees to use the Platform in a manner consistent with the law, good morals, and these Terms of Service. In particular, the following are prohibited:

  • Posting content that infringes on the rights of third parties, including copyrights, personal rights, or image rights.

  • Posting content that is illegal, offensive, discriminatory, vulgar, or pornographic.

  • Using the Platform in a manner that disrupts its operation, including automatically downloading data without the Service Provider’s consent.

  • Taking actions intended to gain unauthorized access to the Platform.

  • Using the Platform to distribute unsolicited commercial information (spam).

5. User Content and Contest Submissions

The user declares that the Submissions he or she uploads to the Kontrastreg platform (photos of figurines, descriptions, model specifications) are his or her own work or that he or she holds all rights necessary for their publication on the Platform.

By submitting an Entry, the User grants the Service Provider and the Contest Organizer a non-exclusive, royalty-free, worldwide license to publish, reproduce, and display the Entry as part of the Platform’s operations and Contest materials, including on the Contest’s social media, in promotional materials, and in the Entry gallery.

The license referred to in the preceding paragraph is granted for the duration of the Account’s use and—with respect to Contest Submissions and their results—for an indefinite period, in order to preserve the integrity of the Contest’s history.

The Service Provider and the Organizer reserve the right to moderate and remove content that violates the provisions of the Terms and Conditions.

6. Rules for Participation in the Contest

The detailed rules for participation in the Contest, including categories, difficulty levels, entry fees, submission deadlines, and prizes, are set forth in the separate Contest rules published by the Organizer.

The results of the Contest are determined by judges appointed by the Organizer and are final. Complaints regarding the results of the Contest will be considered by the Organizer in accordance with the rules of the respective Contest.

The user agrees that his or her Entry may be displayed during the in-person event of the Contest and may be photographed or filmed as part of the event’s documentation.

7. Registration Fees

Participation in the contest is free for Users.

8. Complaint Procedure

The user has the right to file a complaint regarding the services provided by the Service Provider through the Platform. Complaints must be submitted electronically to the following email address: kontakt@kontrastfest.pl.

The complaint should include the User's information, a description of the problem, and the expected solution.

The Service Provider will review the complaint within 14 days of receiving it and will notify the User of the outcome via email.

Complaints regarding the conduct of the Contest itself (including results, disqualifications, and failure to award prizes) will be reviewed by the Organizer in accordance with the separate Contest rules.

9. Liability

The Service Provider makes every effort to ensure that the Platform operates continuously and reliably; however, it does not guarantee uninterrupted availability of the services. The Service Provider reserves the right to temporarily limit or suspend the provision of services for the purpose of maintenance, updates, or troubleshooting.

The Service Provider is not liable for content posted by Users, including Contest Submissions. The User is responsible for ensuring that such content complies with the law.

The Service Provider is not liable for the actions of the Contest Organizer, including the awarding or non-awarding of prizes and the conduct of the in-person portion of the Contest.

The limitations of liability set forth above do not apply to damages caused by the Service Provider’s willful misconduct and do not exclude liability arising from mandatory provisions of law.

10. Termination of the Agreement and Deletion of the Account on the Kontrastreg.pl Platform

The user may terminate the contract for the provision of electronic services at any time by deleting their Account. To do so, the user must contact the Service Provider by email at piotr@minielysium.pl.

The Service Provider may terminate the agreement with the User immediately in the event of a gross violation of the Terms of Service, including the posting of content that violates the law or infringes upon the personal rights of third parties.

Deleting an account does not delete data regarding past editions of the Contest or awards that have been granted. This data may be stored in an anonymized form to preserve the integrity of the Contest’s history.

11. Protection of Personal Data

The rules governing the processing of Users' personal data are set forth in the Privacy Policy, available at /privacy-policy.

The Service Provider is the controller of Users’ personal data on the Kontrastreg.pl platform. For inquiries regarding personal data, please contact: piotr@minielysium.pl.

12. Amendments to the Rules and Regulations

The Service Provider reserves the right to amend these Terms and Conditions for valid reasons, in particular in the event of changes in the law, the introduction of new Platform features, or changes to the scope of services provided.

13. Final Provisions

In matters not covered by these Terms and Conditions, the provisions of Polish law shall apply, in particular the Civil Code, the Act on the Provision of Electronic Services, and the Consumer Rights Act.

Any disputes arising from the application of these Terms and Conditions shall be resolved by the court having jurisdiction under Polish law. With respect to Users who are consumers, the court of the Consumer’s place of residence shall have jurisdiction.

These Terms and Conditions are effective as of June 14, 2026.
